COOKIE DISCLOSURE, NOTICE, AND CONSENT
TCA collects this information to optimize the experience on its website and to collect statistically accurate
data about the use of its website. By using the Texas Counseling Association (“TCA”) website,
www.txca.org, including any and all subpages, (“WEBSITE”), you consent to TCA’s practices as described
hereafter. TCA’s Privacy Policy and Cookie Disclosure, Notice and Consent (“POLICY”) explains its online
information practices and governs data collection and usage. POLICY is applicable only to information
TCA collects over the Internet. POLICY does not apply to third-party websites that you access from TCA’s
website, including any and all subpages.
1. To optimize the experience and enhance the performance and functionality of WEBSITE. TCA uses
web measurement and customization technologies, including but not limited Cookies, Web Beacons, and
other technologies for tracking and measuring website performance and usage (“COOKIES”).
(a) COOKIES are small text files that your web browser stores on your computer. Cookies are
designed to ensure a more user-friendly web experience for the visitor and provide web functionality on
access.
(i) Cookies can be classified as either “essential” or “non-essential.”
Essential cookies: Are cookies that are website’s basic form of memory, used to store the settings
selected by a user on a given site. As the name implies, they are essential to a website’s
functionality and cannot be disabled by users. For example, an essential cookie may be used to

(iii) Cookies can be classified as “first party” or “third party.”
First party cookies: these are cookies placed on your device by TCA when you visit WEBSITE.
Third party cookies: these are cookies placed on your device by third party website domains. TCA
authorize Google, Facebook, LinkedIn, and Instagram to install third party cookies through
WEBSITE.
(b) COOKIES also include Web Beacons (also known as 1x1 GIFs, clear GIFs, tokens, or pixel tags),
are small pieces of data on users’ computers, combined with Third Party COOKIES, determine if a user has
visited a particular website/webpage and how the user navigates through and process the content of the
site/page to personalize the visit, make it more user friendly, and aid in providing more relevant
information to the user.
2. (a) WEBSITE may use any combination of COOKIES. COOKIES are only installed on computers that have
visited WEBSITE.
(b)(i) To furthermore promote transparency, TCA discloses there are third-party companies that are
able to install COOKIES which can acquire and track your personally identifiable information (“PII”) through
WEBSITE. Google and various other websites that are listed below can track you through WEBSITE as TCA
use their services for social media, usage analysis, behavior tracking, and infrastructure purposes.

(d) TCA will revise POLICY as needed to address the evolution of technology.
3. TCA collects information to distinguish between new and returning visitors and track aggregate visitor
participation in surveys, outreach, or public interaction.
4. TCA uses information it collects using COOKIES only for TCA purposes, and discloses the information
only to TCA employees, agents, contractors, and representatives for those purposes.
5. TCA will use reasonable effort comply with all applicable statutes and policies in regards to protecting
the privacy and security of information it collects using COOKIES.
6. You can opt-out and remove or block the use of COOKIES by changing the setting of your browser. The
“Help” feature of most browsers will tell you how to prevent your browser from accepting new COOKIES or
how to disable COOKIES altogether. If you consent to COOKIES and subsequently withdraw your consent,
you will need to manage the settings on your browser to delete all COOKIES and disallow further
acceptance of COOKIES. Please note that disabling COOKIES on your browser will prevent TCA from
tracking your activities on WEBSITE, however, it may also disable some of the functions and features and
WEBSITE may not work properly.
7. (a) If you choose to opt-out, TCA will always make comparable information or services available to
you. You should be aware that changing the settings in your browser to block COOKIES probably will affect
interactions with other websites that use cookies.

8. TCA may collect personal information about you (such as, name, e-mail address, home or work
address or telephone number, or other unique information that identifies user) only if you specifically and
knowingly provide it to TCA.
9. TCA does not collect credit card information when you make a payment through the website. Credit
card information for processing payments made to TCA through its website is encrypted and transmitted
to BluePay.
10. Be aware if you directly disclose PII or personally sensitive data through TCA’s public discussion
boards, this information may be collected and used by others. TCA advises against such disclosure and is
not responsible or liable for such disclosures of PII or personally sensitive data.
11. TCA has no control, responsible, or liability for the privacy policy or other content on any websites,
including any and all subpages, outside of WEBSITE.
12. (a) TCA will disclose certain information to local, state, federal, national, or international government
or law enforcement authorities when required by law. TCA will disclose information to third parties as
necessary in order to comply with applicable laws and regulations.
(b) TCA does not knowingly collect PII from children under the age of thirteen. If you are under the
age of thirteen (13), you must ask your parent or guardian for permission to use TCA’s website.
